General Terms and Conditions of Sale
This document, "General Terms and Conditions of Sale," sets the terms applicable to sales between visitors/customers making purchases on the Xonevo website and the company ONEVO, which operates under the trade name Xonevo.
Article 1 - Acceptance of the General Terms and Conditions of Sale
At the time of ordering, the customer acknowledges having read this document and declares acceptance of these terms without reservation.
Acceptance of these conditions is confirmed by clicking a checkbox clearly labeled with the text: "I accept the general terms and conditions of sale and acknowledge having read them."
Once checked, this box serves as the customer's electronic signature and validates the order. This form of "electronic" signature at the time of purchase has the same contractual impact as a traditional handwritten signature.
No order can be validated without approval of these "general terms and conditions of sale." By definition, any order placed on the Xonevo website implies consultation and approval of the "general terms and conditions of sale."
Article 2 - Application of the General Terms and Conditions of Sale
These terms apply to all orders placed on the Xonevo website. The website is published and operated by Xonevo, a single-member limited liability company with a capital of €10,000. The company's headquarters are located at 25 rue de la Petite Duranne, 13290 Aix-en-Provence, and it is registered with the Aix-en-Provence Trade and Companies Register.
Article 3 - Online Purchase Procedures
The characteristics of products are indicated on the description page of each item, in compliance with Article L 111-1 of the Consumer Code, which ensures that the customer can access the essential characteristics of the product before making a final purchase decision.
Product descriptions and photos are not contractually binding; they are intended to present the product and assist the customer in making a choice. In the event of errors in these elements, ONEVO cannot be held liable.
Product availability is displayed on the Xonevo website. If a product is unavailable, ONEVO will contact the customer as soon as possible to update them on the order status. The customer will be informed of the restocking timeline and the availability of the order. If the customer cannot wait for this period or if the product is permanently unavailable and has already been paid for, ONEVO commits to refunding the customer within 30 days from the payment date.
Offers and promotional operations are valid only while supplies last and sometimes for limited durations, which are directly specified on the website.
Article 4 - Pricing
Product prices displayed on the website are in euros, inclusive of all taxes. Changes in VAT rates may impact the prices. Product prices do not include delivery fees.
The delivery costs are calculated and automatically generated based on each order. The shipping fee is displayed in the order summary before payment is processed.
ONEVO reserves the right to modify prices on the website at any time. However, ONEVO commits to maintaining the price indicated at the time of order confirmation (order form), provided the product is available on that date.
Ownership of the order transfers to the customer only after full payment is completed. Until then, ONEVO retains ownership of the products. Partial payments that do not correspond to the total order amount cannot be considered as deposits or down payments.
Article 5 - Payment Methods
The Xonevo website offers different payment methods for customers to complete their purchases.
Orders paid via credit card (CB, MasterCard, Visa) must be settled in full at the time of purchase. A secure server is in place on the site to ensure the security and confidentiality of banking details during the transaction.
The website also allows customers to pay via bank transfer. In this case, the transfer must be received and verified by Xonevo within a maximum of five business days after order confirmation. If this deadline is exceeded, Xonevo reserves the right to cancel the order.
Orders will be considered valid and accepted by Xonevo only once the site's banking partners have approved them. Even after approval, Xonevo reserves the right to accept orders based on its own criteria to minimize fraud risks.
Additionally, Xonevo reserves the right to request identity and address verification from the cardholder. Once the required documents are received and verified, Xonevo may choose to validate the order.
If the requested documents are not received or deemed non-compliant, Xonevo may cancel the order and issue a refund.
Article 6 - Delivery and Shipping Terms
Products are shipped to the address provided by the customer during the order process. Shipment occurs after payment validation by both the bank and Xonevo. The order is then delivered within 2 to 5 days in mainland France (subject to product availability). Learn more about our delivery methods
Various carriers may handle delivery, either based on the customer's choice or eligibility criteria depending on the specified delivery address.
It is the customer's responsibility to verify the condition of the delivered merchandise before signing any delivery document. The customer is solely responsible for assessing the condition of the order at the time of receipt.
Checking the package is considered complete once the customer or an authorized person signs the document and accepts the merchandise.
If any issues are noticed, the customer must note their concerns along with their signature on the delivery document.
If there is an actual issue (damaged packaging, open package, missing or damaged items), the customer must refuse the package and indicate the reason on the transport document.
Additionally, whether an issue is discovered after opening or at the time of delivery leading to a package refusal, the customer must notify the carrier in writing via registered mail with acknowledgment of receipt within two business days. The customer must also send a copy of this letter by regular mail to the following address:

If the order is made available for pickup and the customer fails to collect it within the designated timeframe, it will be returned to Xonevo, with return shipping costs charged to the customer.
If the customer does not contact Xonevo, the return will result in order cancellation and a refund, minus return shipping costs.
For significant delivery delays, customers should contact us by phone or email.
Upon receiving a complaint, we will contact the carrier to initiate an investigation, which may take up to 21 days.
If the package is found during the investigation, it will be immediately redirected to the customer.
If after 21 days the package remains lost, Xonevo will either resend the order or offer a refund if the product is out of stock.
We are not responsible for delivery services and disclaim liability for extended delivery times, including lost packages or strikes.
The tracking system is authoritative. If a package is marked "delivered" but not received, the customer must contact the carrier.
Article 7 - Force Majeure
Neither party will be held liable for contract breaches caused by unforeseen circumstances beyond their control.

9.2.3. Conditions and Deadlines Related to Our Services for Professionals
In case of cancellation of your order related to our virtual reality services:
- More than 14 days before the start date of the service: we retain 50% of the deposit on the total amount of the service.
- Less than 14 days before the start date of the service: we retain 100% of the deposit on the total amount of the service.

For any complaints about an order, please have your order number ready and provide it to us. You will find this number on your order confirmation, which is sent by email to the address provided when creating your customer account on the Xonevo website.
Article 11 - Applicable Law
These general conditions are subject to French law. This applies to both substantive and procedural rules.
